Warranty & Returns

This limited warranty applies to residents of the United States only and contains a class action waiver. BY USING THE PRODUCT, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS LIMITED WARRANTY. BEFORE USING THE PRODUCT(S), PLEASE READ THIS LIMITED WARRANTY CAREFULLY. IF YOU DO NOT AGREE TO THE TERMS OF THIS LIMITED WARRANTY, DO NOT USE THE PRODUCT(S). RETURN THE PRODUCT(S) TO THE DEALER OF PURCHASE. SEE THE DEALER’S RETURN POLICY FOR DETAILS AND/OR ADDITIONAL RETURN REQUIREMENTS.

WARRANTY PERIOD AND COVERAGE

Products are warranted for one-year against non-conformance with luca + lex material and workmanship specifications commencing from the date of manufacture under the following conditions ONLY:

1. The warranty claim is made by the original purchaser of the Product with a valid proof of purchase from an authorized luca + lex dealer (i.e., this limited warranty does not extend to purchases made from: (i) auction sites such as eBay or Craigslist, (ii) unauthorized dealers selling via third party marketplaces such as Amazon Marketplace, or (iii) dealers selling altered, doctored or counterfeit products);
2. The Product has not been subjected to accident, misuse, abuse, commercial use, improper service, or non-luca + lex repair or modification; and
3. Claims are made within the applicable Warranty Period.

THIS LIMITED WARRANTY DOES NOT COVER AND LUCA + LEX IS NOT RESPONSIBLE FOR:

1. Normal wear and tear
2. Cosmetic damages such as minor scratches and discoloration
3. Damages caused by misuse, abuse, accident, negligence or weather
4. Failure to reasonable care for the Product(s)
5. Modifications
6. Products purchased “as-is”, “used” or “final sale”

EXCLUSIONS AND LIMITATIONS

TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, THERE ARE NO EXPRESS WARRANTIES OTHER THAN THOSE DESCRIBED ABOVE. LUCA + LEX DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, ANY IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WILL BE LIMITED IN DURATION TO THE WARRANTY PERIOD SET FORTH ABOVE. SOME STATES (INCLUDING NEW JERSEY) AND PROVINCES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

LUCA + LEX WILL NOT BE RESPONSIBLE FOR LOSS OF USE, LOSS OF INFORMATION OR DATA, COMMERCIAL LOSS, LOST REVENUE OR LOST PROFITS, OR OTHER INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF LUCA + LEX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF THE REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME STATES (INCLUDING NEW JERSEY) AND PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

IN LIEU OF ANY OTHER REMEDY FOR ANY AND ALL LOSSES AND DAMAGES RESULTING FROM ANY CAUSE WHATSOEVER (INCLUDING LUCA + LEX’S NEGLIGENCE, ALLEGED DAMAGE, OR DEFECTIVE GOODS, NO MATTER WHETHER SUCH DEFECTS ARE DISCOVERABLE OR LATENT), LUCA + LEX MAY, AT ITS SOLE OPTION AND IN ITS DISCRETION, REPAIR OR REPLACE YOUR PRODUCT, OR REFUND ITS PURCHASE PRICE. AS NOTED, SOME STATES (INCLUDING, NEW JERSEY) AND PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

HOW THE LAW APPLIES

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. This warranty applies to the greatest extent permitted by applicable law.

RETURNS

Return claims on stock orders are subject to inspection by luca + lex for the cause of the alleged defects and/or problems with the product(s) within 30 days of purchase. If approved, the return claim shall be limited to either a refund of the purchase price, or replacement of the items. Items must be in original packaging in new condition. Returns may be subject to shipping and 10% restocking fees. If after inspection by luca + lex, it is determined that the product has been installed and/or maintained in a manner that is not in compliance with the guidelines provided by luca + lex then no return will be accepted. No returns on custom orders.
